We have all heard for several days now that Secretary of War, Pete Hegseth, has committed war crimes in the deaths of Venezuelan drug smugglers.
WAR CRIMES? There has been no WAR declared by the USA against any country. I find it extremely difficult to charge anyone with “war crimes” without a war being declared. These charges were made by the now leftwing Communists we once knew as Democrats. The majority of DemonRat voters either haven’t yet recognized that transformation of their political party, or they just don’t care. Regardless of their reasoning, their continued participation makes them ideologically anti-Constitutional, anti-American and therefore anti-individual freedoms.

MURDER? Illegal Venezuelan drugs kill/murder tens of thousands of Americans every year from illicit drug use! Yes, most of those deaths are the result of bad choices, yet we do not label them suicides.
The elimination of drug smugglers in international waters is an act of protection of American lives. Drug smugglers are felony criminals.
The Uniform Code of Military Justice (UCMJ) addresses lawful and unlawful orders primarily through Articles 90 and 92: Article 92 criminalizes failure to obey orders or regulations, and Article 90 criminalizes willful disobedience of a superior commissioned officer. Court opinions and practice explain an order is lawful when it serves a valid military purpose, is clear and specific, and does not conflict with statute or the Constitution.

Article 90 criminalizes willfully disobeying a superior commissioned officer and thus complements Article 92 when the order is a direct command to a particular subordinate. It is my understanding that the order was issued to a group, not a particular subordinate, and therefore does not meet the requirements of (10 U.S.C. § 892) Articles 90/92.
§892. Art. 92. Failure to obey order or regulation
Any person subject to this chapter who-
(1) violates or fails to obey any lawful general order or regulation; (emph added)
(2) having knowledge of any other lawful order issued by a member of the armed forces, which it is his duty to obey, fails to obey the order; or
(3) is derelict in the performance of his duties;
shall be punished as a court-martial may direct.
BOTTOM LINE… the Communists have been very patient, taking more than 100 years to blatantly make their presence in all our government agencies publicly known. The UCMJ does permit the refusal to comply with illegal orders, which is done at the individual’s personal risk.
Those who carried out such orders – if in fact there were such orders issued – would probably be found innocent of murder by any objective judge and jury.
